1. Acceptance of Terms

By using Green Wheels Byron’s services (rentals, sales, website), you agree to these Terms.
1.2 Modifications
We reserve the right to update these Terms at any time. Continued use of our Services after changes constitutes acceptance.
1.3 Eligibility
You must be at least 18 years old to rent or purchase e-bikes. By proceeding, you confirm you are legally capable of entering into a binding contract.
1.4 Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in NSW courts.

2. Services Provided
2.1 E-Bike Sales
Green Wheels Byron sells new e-bikes directly to customers. Sales are final unless covered under our refund policy in Section 5. Prices vary by model and are subject to change. Customers are responsible for reviewing product details before purchasing.
2.2 Rental Services
E-bikes are available for rent on an hourly, daily, or long-term basis. Discounts apply based on the specific rental duration. The rental period begins at pickup and ends upon return. Reservations must be made in advance, and customers must present valid identification. Green Wheels Byron reserves the right to refuse rentals if safety or eligibility requirements are not met.
2.3 Pricing
E-bike sale prices depend on the model and are available online. Rentals start at $90 for 24 hours, with discounts for longer durations. Prices are in AUD and may change without notice. Full payment is required before purchase or rental.
2.4 Availability
All sales and rentals are subject to availability. Green Wheels Byron does not guarantee stock for specific models. We reserve the right to cancel reservations due to stock shortages or safety concerns, offering rescheduling or refunds where applicable.
2.5 Briefing Requirement
All renters must attend a mandatory pre-rental safety briefing to understand e-bike operation and safety guidelines. Customers must confirm their understanding before taking possession of the e-bike. Failure to complete the briefing may result in cancellation without refund. Before renting, the Pre-Rider Ability Checklist must be completed.
3. Rentals
3.1 Rental Period
The rental period starts at the agreed pickup time and ends when the e-bike is returned. Late returns will be charged at a rate of $25 per hour. Renters are responsible for returning the e-bike on time to avoid additional fees.
3.2 Security Deposit
A refundable $450 security deposit is required for all rentals.The deposit will be returned within 10 business days if the e-bike is returned in its original condition, with no damage or missing parts.
3.3 Condition of E-Bikes
Before and after each rental, Green Wheels Byron will take photos to document the e-bike’s condition. Renters are responsible for any damage, loss, or theft that occurs during the rental period. Any necessary repairs or replacements will be deducted from the security deposit.
3.4 Long-Term Rentals
Special terms apply for long-term rentals, including monthly rates and maintenance coverage. Customers must contact Green Wheels Byron directly for pricing and terms before booking a long-term rental.
4. Sales & Purchases
4.1 Pricing
All e-bike prices are listed in Australian Dollars (AUD) and may change without prior notice. Customers should check the latest prices online or in-store before purchasing.
4.2 Order Confirmation
An order is only considered final once full payment has been received. Upon successful payment, customers will receive an email confirmation with purchase details.
4.3 Delivery
Delivery options, fees, and estimated timelines vary depending on location. Customers must inspect their e-bike upon delivery and report any issues immediately. Green Wheels Byron is not responsible for damage reported after acceptance.
4.4 Title Transfer
Ownership of the e-bike is officially transferred to the buyer once full payment has been processed. Green Wheels Byron is not liable for any loss or damage after the sale is completed.
5. Returns, Refunds & Warranties
5.1 Faulty Goods
Customers may request a refund or exchange for defective products, provided they submit proof of the defect. Green Wheels Byron will cover return shipping costs for faulty items. Refunds or exchanges will be processed only after the item has been inspected and confirmed to be defective.
5.2 Change of Mind
Returns are accepted within 30 days of purchase if the e-bike is unused, unassembled, and in its original packaging with all accessories. A 15% restocking fee applies to unassembled items returned after 7 days. Sale or discounted items are final sale and cannot be returned. Cancellations are free up to 24 hours before the scheduled pickup time. A $45 fee applies for cancellations made within 12 to 24 hours before pickup, and a $90 fee applies for cancellations within 12 hours or for failure to show up.
5.3 Warranties
All warranties are provided by the manufacturer. Green Wheels Byron may assist with warranty claims but is not responsible for repairs or replacements. We reserve the right to charge for labor or administrative costs related to warranty claims.
5.4 Return Process
Customers must contact Green Wheels Byron to obtain return authorization before sending back any item. Unauthorized returns will be refused. Return shipping costs are the customer’s responsibility unless the return is due to a product defect or an error on our part.
6. User Responsibilities
6.1 Safe Use
Renters and purchasers must follow all local traffic laws and safety regulations while using the e-bike. E-bikes should only be used on approved terrains and not in restricted or hazardous areas. Users must operate the e-bike responsibly and avoid reckless behavior, such as excessive speeding, off-road riding, or any actions that may cause harm to themselves, others, or the e-bike.
6.2 Maintenance
Users are responsible for minor maintenance, such as inflating tires and basic upkeep. Any major mechanical issues must be reported to Green Wheels Byron immediately. Repairs for normal wear and tear during rentals will be handled by Green Wheels Byron at no cost to the renter, provided the damage is not caused by misuse or negligence.
6.3 Prohibited Actions
Users are strictly prohibited from tampering with or modifying any e-bike components, including the motor, battery, or speed settings. Subleasing or transferring a rental e-bike to another person without prior authorization from Green Wheels Byron is not allowed. Additionally, users must not ride under the influence of alcohol or drugs, engage in stunt riding, racing, off-road use, or water submersion. Commercial use (e.g., delivery services, advertising) is also prohibited. Users are liable for any damages caused to third parties, including pedestrians, vehicles, or property. Violations of these terms may result in immediate termination of the rental agreement and loss of the security deposit.
6.4 Loss, Theft & Accidents
E-bikes not returned within 48 hours are considered lost or stolen, which may result in a police report. Accidents, damage, or theft must be reported to Green Wheels Byron within 2 hours. For personal injury or theft, users must file a police report within 24 hours.
6.5 Safety
Users must refrain from distractions while riding, including phone use or carrying large bags. Caution must be exercised in areas without bike lanes.
7. Security Deposit & Liability
7.1 Deductions
The security deposit may be partially or fully withheld if the e-bike is returned with damage beyond normal wear and tear, including but not limited to frame dents, motor or battery issues, or excessive scratches. The deposit will also be used to cover theft or loss of the e-bike or any included accessories. Additionally, late return fees will be deducted if the bike is not returned on time. Any remaining balance after deductions will be refunded within 10 business days.
7.2 Disputes
If a renter disagrees with any deductions from their security deposit, they must submit a written dispute to Green Wheels Byron within 14 days of the deduction notice. Green Wheels Byron will review the claim and provide a final decision based on rental records, inspection reports, and photographic evidence.
8. Liability Waiver
8.1 Assumption of Risk
By using an e-bike purchased or rented from Green Wheels Byron, users acknowledge and accept that cycling carries inherent risks, including accidents, injuries, weather conditions, and mechanical failures. Green Wheels Byron is not liable for any accidents, injuries, or damages caused by third parties, including but not limited to motor vehicles, pedestrians, or other cyclists. Green Wheels Byron is not responsible for any harm, loss, or damages resulting from the user’s operation of the e-bike. Users are also responsible for ensuring they are physically capable of riding safely and must adhere to all safety guidelines. Green Wheels Byron is not liable for mechanical failures caused by user negligence, improper use, or lack of maintenance.
8.2 Limitation of Liability
In the event of a claim, Green Wheels Byron’s total liability is strictly limited to the amount paid for the service or product. Under no circumstances will Green Wheels Byron be responsible for indirect, incidental, or consequential damages, including personal injury, lost income, or third-party claims.
9. Privacy
Green Wheels Byron collects personal information (e.g., names, contact, payment details) only to process sales, rentals, and service requests. We protect this data with industry-standard security measures and do not share it with third parties for marketing. For more details, please refer to our Privacy Policy.
10. Termination
10.1 By Us
Green Wheels Byron reserves the right to suspend or terminate a user’s access to our services if they violate these Terms, engage in fraudulent activity, misuse e-bikes, fail to make required payments, or pose a safety risk. In such cases, any outstanding fees or charges will remain due, and Green Wheels Byron may refuse future service.
10.2 By You
Users may discontinue using Green Wheels Byron’s services at any time. However, they remain responsible for any outstanding fees, including unpaid rentals, damages, or cancellation charges. Termination of use does not entitle users to a refund unless otherwise specified in these Terms.
11. General
11.1 Force Majeure
Green Wheels Byron is not responsible for any delays, disruptions, or failure to fulfill obligations due to events beyond our control. This includes but is not limited to natural disasters, extreme weather, government restrictions, supply chain disruptions, strikes, or unforeseen technical failures. In such cases, Green Wheels Byron reserves the right to modify or suspend services without liability.
11.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full effect. The invalid portion will be modified or removed to the minimum extent necessary to comply with applicable laws while maintaining the intent of the Terms.
11.3 Governing Law
These Terms are governed by and interpreted in accordance with the laws of New South Wales, Australia. Any disputes arising under these Terms shall be resolved in the courts of New South Wales.
11.4 Dispute Resolution
Any disputes will be resolved through binding arbitration in New South Wales, Australia. Both parties waive the right to litigate, except to enforce the arbitration award.
11.5 No Waiver
Failure by Green Wheels Byron to enforce any provision of these Terms does not constitute a waiver of our rights. We may still enforce our rights at any time.
11.6 Amendments
Green Wheels Byron reserves the right to update or modify these Terms at any time. Continued use of our services after such changes constitutes acceptance of the updated Terms.
11.7 Entire Agreement
These Terms, along with any policies referenced herein, constitute the entire agreement between the user and Green Wheels Byron regarding the use of our services. They supersede any prior agreements, whether written or verbal.
11.8 Assignment
Users may not transfer or assign their rights or obligations under these Terms without prior written consent from Green Wheels Byron. We may assign our rights and obligations to another entity without notice.
