GREEN WHEELS BYRON – E-BIKE RENTAL AGREEMENT
This e-bike Rental Agreement (the "Agreement") is entered into between Green Wheels Byron (the "Lessor"), located at 18 Mahogany Dr, Byron Bay NSW 2481, and the individual identified as the Lessee (the "Renter").
1. RENTAL DETAILS
1.1 The rented e-bike shall be identified by its make and model, along with its serial number. Any provided accessories, such as a helmet, lock, and charger, will also be documented in this Agreement.
1.2 The rental period begins on the agreed Start Date and Time and ends on the specified End Date and Time. The Renter must return the e-bike to the designated location at the end of the rental period.
1.3 The rental fee is set at $90 per day, which constitutes a 24-hour rental period. Green Wheels Byron may offer discounts for extended rentals, subject to prior agreement.
1.4 A security deposit of $450 is required before the rental period begins. The deposit will be returned within ten business days, provided there are no outstanding fees or damages.
1.5 The Renter acknowledges that late returns may incur a $25 per hour fee or an additional day's charge if delayed by more than six hours.
2. RENTER RESPONSIBILITIES
2.1 The Renter must operate the e-bike in compliance with local traffic laws and use it only on paved roads and designated cycling paths. The Renter must wear a helmet at all times while riding the e-bike.
2.2 The Renter is strictly prohibited from making any modifications to the e-bike, including but not limited to altering the motor, battery, or electrical components.
2.3 The Renter shall not sublease, transfer, or otherwise allow any third party to use the e-bike during the rental period. The e-bike is for the personal use of the Renter only.
2.4 The Renter must keep the e-bike in basic working condition, including inflating the tires and charging the battery. Any issues must be reported to Green Wheels Byron immediately. The Renter shall not attempt repairs without express authorization.
3. FEES & LIABILITY
3.1 A late return fee of $25 per hour shall be applied if the Renter does not return the e-bike at the agreed-upon time. If the delay exceeds six hours, the Renter may be charged for an additional full rental day.
3.2 The Renter is responsible for any damage beyond normal wear and tear. They must cover the full cost of repairs, including parts and labor. If the e-bike cannot be repaired, the Renter must pay the full replacement value.
3.3 In the event of theft or loss, the Renter shall be liable for the full replacement cost of the e-bike and any accessories provided at the time of rental.
3.4 A cleaning fee of $50 shall be applied if the e-bike is returned excessively dirty or covered in mud, sand, or debris.
3.5 Any unpaid fees, damages, or penalties may be deducted from the security deposit. If the total outstanding amount exceeds the deposit, the Renter agrees to pay the balance immediately upon notification by Green Wheels Byron.
4. GPS Tracking
4.1 All rented e-bikes are equipped with GPS tracking devices for security, maintenance, and operational purposes.
4.2 Green Wheels Byron may access GPS data to:

Locate lost or stolen e-bikes.

Ensure compliance with this Agreement, including authorized usage areas.

Retrieve overdue rentals if the Renter fails to return the e-bike on time.
4.3 GPS tracking does not actively monitor real-time movement unless necessary under the conditions in 4.2.
4.4 Green Wheels Byron will only access GPS data in cases of theft, rental violations, or failure to return the e-bike as agreed.
5. CANCELLATIONS & REFUNDS
5.1 The Renter may cancel their reservation at no cost if done at least 24 hours before the rental begins. A full refund will be issued for timely cancellations.
5.2 Cancellations made within 12 to 24 hours of the rental start time shall incur a $45 cancellation fee, which shall be deducted from the refund amount.
5.3 Cancellations made within 12 hours of the rental start time or failure to collect the E-Bike shall result in a $90 charge, equivalent to the full-day rental rate.
5.4 Green Wheels Byron reserves the right to cancel a rental agreement due to extreme weather conditions, e-bike unavailability, or safety concerns. If Green Wheels Byron cancels, the Renter shall receive a full refund.
6. GENERAL TERMS
6.1 The Renter acknowledges that operating an e-bike carries inherent risks and assumes full responsibility for their safety and actions.
6.2 Green Wheels Byron is not liable for any injuries, losses, or damages resulting from misuse or failure to adhere to safety guidelines.
6.3 Further legal provisions, including liability waivers and dispute resolution, are outlined in the General Terms of Service (ToS), which the Renter agrees to by signing this Agreement.
By signing below, the Renter confirms that they have read, understood, and agreed to the terms outlined in this Agreement and the General Terms of Service.
